- Abstract
The article discusses the court case George Smiljanich v. General Motors Corp. (GM) on equitable estoppel claim under the Employee Retirement Income Security Act (ERISA) in Michigan. Smiljanich sued GM for failure to comply with its promise that his length of service would be bridged, upon his return to GM. Moreover, the district court sided with him claiming that GM violated the estoppel under ERISA and ordered GM to award fees equivalent to his denied benefits claim.
