- Abstract
The article discusses the various terms and legal framework for mobile work. It emphasizes that even with decentralized work, occupational health and safety must be ensured. Questions are raised about how the standards of humane work can be maintained in decentralized work and what role works council participation plays in this. It emphasizes that the responsibility for compliance with the standards and the costs lie with the employer. Various forms of decentralized work such as home work and telework are discussed. It also addresses the works council's participation rights in the introduction and design of mobile work. It emphasizes that works agreements and clear rules for working hours and the use of work equipment are important. Participation rights can be enforced through works agreements or the arbitration board. It is pointed out that the possibilities for works council participation depend on the size of the works council and the professionalism of works council work. Collective agreements and government regulations can support participation rights and establish framework conditions for mobile work. It also points out a new regulation in Portugal that sanctions companies that contact employees outside of working hours and prohibits the technical monitoring of mobile work. The design of the working world after Corona requires further regulations in Germany to reconcile the effects of digitization and flexibilization with the requirements of humane work.
