- Title
"ONLY A RECOMMENDATION": HOW DELAWARE CAPITAL SENTENCING LAW SUBVERTS MEANINGFUL DELIBERATIONS AND JURORS' FEELINGS OF RESPONSIBILITY.
- Authors
KLEINSTUBER, Ross
- Abstract
The article discusses how hybrid statutes affect jurors' perceptions of responsibility with reference to several Supreme Court cases in Delaware. It utilizes some actual penalty trial transcripts of court cases to show that not only are capital jurors in one hybrid sentencing state failed to take their sentencing responsibility seriously, but that they are actually engaged in a non-deliberative process.
