- Abstract
With the increase in life expectancy caused by technological advances that have taken place since the second half of the 20th century, in our article we intend to (i) understand palliative care from the perspective of the modern hospice philosophy; (ii) recognize the vulnerability of the terminal patient and of those close to him, stating that when a cure is not possible, there is still an ethical duty of care; and (iii) that this duty is established in the Brazilian legal system, even if just in theory. Hence, we will start by presenting a brief background on the philosophy of the modern hospice; then, through exploratory and analytical methodology, we will analyze some important concepts and practices for the debate and, at the end, employing an exploratory methodology, we will verify how the theme is regulated, revealing, through a hypothetical-deductive method, that in spite of the legal duty to provide palliative care, in practice it is not sufficiently present.
