- Abstract
The article discusses a court case wherein Regal-Beloit Corp. filed a suit against Kawasaki Kisen Kaisha Ltd. and Union Pacific Corp. in the California Supreme Court due to the derailment of its containers. The case presented six separate issues as it came to the Supreme Court, however, the court only answered one of them. The Regal-Beloit Court concluded that the Carmack Amendment did not apply to an import shipment. The court resolved the case although the lower courts were a bit disappointed.
