The article focuses on the analysis of adequate briefing standards in the federal circuit courts of appeals. Topics discussed include application of Federal Rules of Appellate Procedure by the appellants for avoiding forfeiting, or waiving of the issue; adequate briefing standards applied by the courts against criminal defendants and pro se litigants, and the difficulties faced by the litigants complying with them; and gap between judicial efficiency and the right to a fair hearing.
