- Abstract
The article explores the author's experiences concerning the Fourth Circuit's death penalty jurisprudence. He described his interest in this jurisprudence as both academic and experiential and examined the statistics on the decisions on whether to affirm or deny habeas corpus relief for death convicts. The reasons for the poor success rate of capital habeas cases in the Fourth Circuit are also explained, including ineffective assistance of counsel, the failure of the prosecution to disclose exculpatory evidence and racial discrimination.
