- Abstract
The article focuses on factors which must be considered by the governments while confiscating private property of enemy nations during a war in the light of international law, the American history, and justice administration. It states that the property of enemy nationals being captured at sea is deemed lawful prize. It is asserted that private property of enemy nations cannot lawfully be confiscated that is found within the realm at the commencement of a war. The property seized as enemy owned may later proved not to enemy-owned.
