- Abstract
Mercy and justice can seem like a contradiction. But this contradiction is only apparent and one virtue needs the other to exist. The virtue of mercy consists in compassion, that is, suffering with the neighbor. The experience of suffering is vital to mercy. Thus, these concepts will be developed in this article. It will also deal with the APAC Method - Association for the Protection and Assistance of Convicts - of compliance with a judicial sentence (Criminal Execution Law) and how this method is based on mercy to achieve justice. APAC does not aim only at relocating the recovering person in society, but rather it aims at his human recovery; a recovery that includes responsibility for the fault committed and an awareness of the need to remedy it. Mercy, in the APAC method, vitally fulfills the dignity of the human person insofar as it makes the recovering persons remember that they are also worthy people. In addition, the performance of the method will also be considered in this article from the point of view of the hermeneutical use of law with a promotional function of the dignity of the human person. For the research, the deductive methodology was used, by means of bibliographic survey of works that deal with the theme, with the objective of provoking a reflection on the participation of society in the scenario of social inclusion of convicts, but with rights to a dignified and fair recovery.
