- Abstract
The article identifies the grounds on which the actions of persons charged with people smuggling offences are justified under the Migration Act of Australia. It evaluates the available case laws and existing legislation in light of international legal requirements and presents recommendations for law reform on the basis of its findings. Topics include smuggling of migrants, recognized defenses against people smuggling offences, and the Australian law of duress.
