The article focuses on the interpretation of the elements of offensive conduct and offensive language under the sections 4 and 4A of the Summary Offences Act 1988 of New South Wales. It discusses the judicial decision of the High Court of Australia in He Kaw Teh v. The Queen regarding the use of public order for interpreting the elements of a statutory offence or criminal law.
