- Abstract
The article discusses the court case BITCO General Insurance Corp. v. Monroe Guaranty Insurance Co., wherein the Texas Supreme Court addressed liability insurers' use of extrinsic evidence to avoid a duty to defend its insureds. The Supreme Court articulated an exception to the eight corners rule which compares factual allegations in the plaintiff's complaint with the insurance policy. The court ruled that it could not consider extrinsic evidence in evaluating the duty to defend.
