- Abstract
The article focuses on the scope of the Major League Baseball (MLB) antitrust exemption and its challenges in respect to licensing and intellectual property. It discusses the MLB's license deal with Topps baseball card company and analyzes the reasons for missing of an opportunity to challenge MLB's antitrust exemption by the Upper Deck, a former Major League Baseball Properties' (MLBP) licensee in the light of the U.S. Supreme Court case American Needle, Inc. v. National Football League.
