- Abstract
The paper analyzes the information obligations to policyholders imposed by the sectoral legislation and the jurisprudence for the commercialization of financial products in the form of insurance. The commercialization of this type of product raises two fundamental questions: The first, concerning its legal nature, is to determine, on the one hand, whether they are real insurances or are investment products and, on the other, what elements are necessary to consider these products as insurance contracts. The second one refers to the requirements required for its commercialization, once its insurance nature has been determined. In this respect, European Union legislation has established similar information obligations for the distribution of insurance products as required for the marketing of retail investment products, but considers that the regulation of such obligations should be reflected in the specific insurance mediation legislation.
