- Abstract
The article offers information the significance of the case Lingle v. Chevron in inclusionary zoning and other legislative and monetary exactions in the U.S. It discusses the views of the Supreme Court on exactions. It highlights the potential of the exactions debate to determine the level of scrutiny that applies to legislatively enforced exactions throughout the country. It recommends that the government should enforce an unconstitutional condition to meet the requirement of the cases Nollan V. California Coastal Commission and Dolan v. City of Tigard.
