- Authors
Davis, Peggy Cooper
- Abstract
The article presents proposals for improving legal education in the U.S. It describes how intelligence bias, intellectual segregation and tracking vexes the learning environment and discourages engagement. It argues that Socratic discourse should acknowledge the psychological, rhetorical, and cultural dimensions of doctrinal interpretation and consider interpretation in the contexts of counseling and advocacy as well as in the context of judicial decision-making. The article calls for a respectful integration of a variety of teaching methods, all dedicated to producing intellectually versatile professionals.
