- Abstract
The article discusses the application of Public Law 86-272 to business activities conducted on the internet. Public Law 86-272 provides corporations that sell tangible personal property with a limited safe harbor from state income taxes. The Multistate Tax Commission (MTC) issued a statement in 2021 on how to apply the law to internet activities, which was followed by regulatory guidance from California and New York. The article provides examples of internet activities that are not protected by Public Law 86-272, as well as activities that are protected. It also mentions that other states are expected to issue similar guidance.
