The article focuses on the issue concerning constitutional constraints which is considered as a subject for inquiry in American constitutional theory. The author offers ideas about constitutional constraint and nonconstraint and formulates a typology of constitutional constraints. It also presents the conceptual apparatus that examines constitutional constraints on the Supreme Court justices.
