- Abstract
This article focuses on the ruling of the Maryland Court of Appeals on the case "Frederick Contractors Inc. v. Bel Pre Medical Center Inc." where the court has ruled out that Bel Pre's demand for arbitration should have had effect of staying the foreclosure proceeding until an award is returned from the arbitration, when any award made in Frederick's favor my be enforced by going forward with the proceeding to foreclose the lien. The court discussed mechanics' liens arising under New York law. Before reaching its decision, the court was faced with the threshold question of timeliness of the demand for arbitration.
