- Title
UNINSURED MOTORIST--SEPARATE POLICIES--DOUBLE RECOVERY NOT PERMITTED.
- Abstract
This article presents information on uninsured motorists. Where two automobiles were covered under a single policy and an unequal premium was paid for uninsured motorist coverage on the two vehicles, it was ruled that an insured, injured while riding a motorcycle, may not have a double recovery. Though uninsured motorist coverage appeared as a separate item for each automobile and a certificate of insurance for each was issued, the court did not consider this as two separate policies and construed the "separability clause" as simply rendering the policy applicable to whichever car is involved in an accident.
