- Abstract
The article examines the consequences of U.S. states use of rights of first refusal for existing in-state monopolies to commandeer any competitive or out-of-state electric power transmission proposals, as of June 2015. Topics discussed include enactment of Federal Power Act; the U.S. Federal Energy Regulatory Commission mandated competition; and ways in which energy future invokes both the Supremacy Clause under Article VIII of the U.S. Constitution and the Commerce Clause under Article I.
