The article offers information on the judicial decision of the Fourth Judicial Department of the Appellate Division of the New York Supreme Court in the case People v. Pealer related to the prosecution of criminal offense of driving under the influence while intoxicated (DWI). It informs that the Court addressed the DWI conviction of defendant Robert Pealer relevant to submission of breath test documents into evidence under the Sixth Amendment's right of confrontation.
