- Abstract
The article presents the author's views on two conceptions of moral rights possession. The most prevailing concept is individualism which determines the moral rights of a subject by virtue of certain right-endowing properties possessed by the subject. Next is externalism which maintains the fact about how a subject is treated in a social environment. Externalism fails to differentiate between moral and legal rights as it cannot characterize legal rights as the product of social practices.
