- Abstract
Employment relationships are being influenced by the ever more prevalent use of social networks as a means to communicate and interact. This can be seen in every phase of the relationship between the employer and the employee, sometimes even before it begins For the time being labour law does not specifically regulate the use of social networks, but there are several judgments that analyse disciplinary measures that have been taken in response to employees' use of social networks. This case law highlights the problems that, a priori, would appear to be the most frequent in this type of proceedings. These include limitation periods, identifying who actually commits a breach, whether the employee's right to privacy is infringed and, therefore, whether the evidence that an employer gathers is lawful. Aside from these procedural problems, other issues that arise are the effect the use of social networks has on employees' productivity and how an employer can monitor this.
