The author reflects on the impact of patent opinions on willful patent infringement cases and damages caused due to these infringement cases. Topics discussed include relationship of patent opinions with attorney-client privilege, role of attorney-client privilege waiver in transforming the U.S. patent system with the help of Leahy-Smith America Invents Act, and the role of the U.S. Patent and Trademark Office (USPTO) in protecting intellectual property rights.
