- Abstract
The article examines the legal rationale behind denial of copyright for clothing designs in the U.S. It discusses the proposed bill of Innovative Design Protection and Piracy Prevention Act and argues against the rationale for defining clothing designs as uncopyrightable. It mentions the court cases Fashion Originators Guild of America v. Federal Trade Commission, Whimsicality Inc. v. Ruble's Costume Co. Inc., and Kieselstein-Cord v. Accessories by Pearl Inc. in support of the argument.
