The article focuses on the issues concerning the Markman versus Westview Instruments Inc. and the Phillips versus AWH Corp. U.S. Supreme Court cases. It examines the divergent scope of claim construction based on the announcement that claim construction is a matter of law. Furthermore, it concentrates on the myriad of contradictory statements that harmonized or utterly muddled the approaches to claim construction.
