The article looks at the history of the discharge waiver under Chapter 7 bankruptcy filing in the U.S. including legal standards for court approval and examines the consequences of such waiver. Topic discussed are procedure and consequences of waiving discharge, statutory requirements for an effective waiver of discharge under the Bankruptcy Code, waiver as settlement of adversary proceeding, contents of a discharge waiver and debtors' reasons for waiving their discharge.
