- Abstract
The author comments on Elizabeth Warren's article "Vanishing Trials: The New Age of American Law," published in the Fall 2005 issue of the "American Bankruptcy Law Journal." Bankruptcy litigation has been declining because compromise is the one thing that makes debtor reorganization possible. The classification of adversary proceeding terminations developed by the Administrative Office of the US Courts is enforced by case administrators in the bankruptcy clerk's offices. Litigation in contested matters differs little from litigation in adversary proceedings.
