- Abstract
The article discusses a court case related to trademarks in video games industry wherein U.S. Ninth Circuit concluded that the virtual building created by the defendant did not infringe the trademark of the real world couterpart. The Ninth Circuit dismissed the case of plaintiff "E. S. S. Entertainment," and stated that "Rockstar Games," dealt only with the issue of trademarks in buildings, however protections for buildings exist under both trademark and copyright law.
