The article examines the U.S. trademark law and doctrinal development of initial interest confusion in the metatags embedded in the HTML code of Web sites. The procedural background of the case "Brookfield Communications v. West Coast Video" was discussed. Key information about the limitations of initial interest confusion is further presented.
