- Abstract
The article reflects peremptory challenges as responsible factors for racial discrimination under the U.S. Supreme Court decision in several cases including Miller-El v. Dretke, Johnson v. California and Snyder v. Louisiana. It discusses the U.S. Supreme Court case Batson v. Kentucky wherein the Court's guidance in the decision was evaluated to determine the use of preemptory challenges. It analyzes the lack of clarity in the law concerning legal evidences in Batson case and its implications.
