The article explores the legal treatment of "heads up" provisions between a government and a private entity regarding consultatory rights or predisclosure notifications and its impact on the free flow of public information. Topics discussed include the provisions between the government of Cincinnati, Ohio and freight railroad firm Norfolk Southern, a solution to improve request trust and process efficiency, and expansion of business information secrecy under the U.S. Freedom of Information Act.
