- Abstract
This article discusses the topic of testamentary capacity and undue influence in older adults. With the global increase in the aging population, there is a growing need for clinicians to assess an individual's capacity to create or amend a will. However, there is currently no standardized assessment procedure for determining testamentary capacity. The article presents different frameworks for evaluating testamentary capacity, emphasizing the legal, clinical, and ethical aspects of the evaluation. It also highlights the importance of assessing cognitive, psychiatric, and financial decision-making factors in determining testamentary capacity. The article suggests that future research should focus on refining and integrating these frameworks to establish a comprehensive and standardized approach to testamentary capacity evaluations.
