- Abstract
The article looks into the potential legal challenge of Chapter 58 of the Acts of 2006, a law that provides access to affordable, quality and accountable health care approved by Massachusetts Governor Mitt Romney, under the preemption clause of the federal 1974 Employee Retirement Income Security Act (ERISA). ERISA intends to limit the burden on employee benefit plans. On the other hand, Chapter 58 relies on employer contributions as a source of revenue for the increased insurance coverage.
