- Abstract
The article offers information on the judicial decision of the Sixth Circuit of the U.S. Court of Appeals in the Ohio married couple case of Hughes v. McCarthy, in which the Court reversed a judgment on treatment of penalty for transfer of assets by an institutionalized spouse to the community spouse. It dscusses the significance of the Centers for Medicare & Medicaid Services (CMS) and National Academy of Elder Law Attorneystreatment of medicaid coverage by the Ohio Medicaid agency.
