- Abstract
The article discusses the author's views about taking a cautious approach to the utilization of predictive coding in judicial proceedings and the electronic discovery (e-discovery) process in the U.S. It states that predictive coding involves computer software that is trained to determine which legal documents and electronically-stored information is legally relevant and non-privileged using algorithms. Document review procedures, U.S. attorneys' attitudes, and law and technology are examined.
