- Abstract
This article offers details on the decision made by the U.S. Court of Appeals for the Seventh Circuit in the case of Environmental Barrier Co. v. Slurry Systems on August 29, 2008. Environmental Barrier filed a demand for arbitration against Slurry Systems Inc. (SSI) on allegations of a breach of a subcontract. The Court ruled that a party seeking to challenge arbitrability must challenge the enforceability of an arbitration agreement.
