- Title
Confusion about "Manifest Disregard" After Hall Street v. Mattel.
- Authors
KELLY, JUSTIN
- Abstract
This article reports that the U.S. Supreme Court decision in March, 2008 regarding the case Hall Street Associates v. Mattel ruled that the grounds for vacating an award under the Federal Arbitration Act (FAA) are exclusive. This has called into question the validity of manifest disregard of the law as understood via the 1953 Supreme Court decision in the case of Wilko v. Swann. The effect of this decision on several Supreme Court cases is discussed, in particular Improv West Associates v. Comedy Club.
