- Abstract
The administrative jurisprudence of the year 2021 was less marked by decisions relating to the health crisis linked to the Covid-19 epidemic. However, the administrative judge intervened on the subject to specify the regime of legality and liability of the vaccination obligation imposed on some professions. The litigation of acts of soft law continues to mature with an increased reference by the court of the effects that such acts can produce with regard to their addressees. Finally, the dialogue between European and national judges will also have marked the year 2021, with a position, with time, difficult to sustain of the administrative judge who does not ensure (or no longer ensures) the full effectiveness of European Law in the name of the supremacy of some French constitutional norms and of the absence of their equivalent protection in the European legal order. Faced with the reaffirmed position of the CJEU of the necessity to uphold, at all events, the European rules, the administrative judge will have to choose and not to try any more to reconcile the irreconcilable.
