- Abstract
The article focuses on the historical analysis of U.S. Supreme Court jurisprudence as it evolved into our current understanding of prosecutorial obligations toward criminal defendants under the Fourteenth Amendment to U.S. Constitution. It uses the case of Brady v. Maryland which established that the prosecution must turn over all evidence that might exonerate the defendant exculpatory evidence to the defense. It also reviews the American Bar Association Model Rules of Professional Conduct.
