- Abstract
Montanans are guaranteed the right to a clean and healthful environment according to the state's 1972 Constitution. This was in response to the destruction caused by the Anaconda Company and the Copper Kings, who polluted rivers, stripped mountainsides, and left toxic waste deposits. However, 52 years later, Montanans are still dealing with the consequences of the Anaconda Company's actions in Superfund sites across the state. The federal Superfund law holds polluters responsible for cleanup costs, but the Environmental Protection Agency (EPA) and Montana's Department of Environmental Quality have been criticized for not fully implementing the law. Citizens in Butte and Columbia Falls are challenging the EPA and state over "catbox cleanups," where waste is left in place instead of being properly removed. The citizens of Montana deserve a full reclamation, as mandated by the state's Constitution.
