- Abstract
The article discusses whether litigation is the proper remedy to address the externalisation policies of some countries to manage or control the migration of refugees and asylum seekers. Also cited are Australia's Operation Sovereign Borders program that aims to bar people arriving by sea to permanently live in the country, and how lawsuits were used as a mechanism to hold Australia accountable and protect the rights of people at regional processing countries (RPC) like Nauru.
