- Abstract
The article presents an update the past review on the state preemption of local smoke-free regulations in U.S. government work sites, private work sites, and restaurants and summarizes changes that took place from 2005 to 2009. The Centers for Disease Control and Prevention (CDC) monitors state laws that preempt local smoking laws through the CDC State Tobacco Activities Tracking and Evaluation system. The Washington State Supreme Court ruled that state law preempted local smoking laws. Other jurisdictions in South Carolina have enacted smoke-free laws.
