- Title
DISPARATE IMPACT, DISPARATE TREATMENT, AND THE DISPLACED HOMEMAKER.
- Authors
YARBROUGH, MARILYN V.
- Abstract
The article analyzes disparate impact theory and disparate treatment theory as two doctrines that relate to the Age Discrimination in Employment Act (ADEA) in the U.S., with particular focus in the context of victims of age discrimination in employment, also known as displaced homemakers. There are several age-related reasons why displaced homemakers are often discriminated in employment. The distressing condition of displaced homemakers has proved that they are less able compared to other people similarly situated to compete for first-time employment.
