- Abstract
The article discusses the alternative risk management approach of creating a captive insurance company to insulate middle-market companies against losses such as those incurred from cyberwarfare or environmental remediation. It is noted that as this approach becomes mainstream, increased U.S. regulation is more likely. Topics include definitions of insurance and insurance contracts under U.S. law, The U.S. Internal Revenue Service (IRS) rulings on risk shifting fund pooling, and the importance of consulting with a captive insurance professional to comply with U.S. law.
