- Abstract
The article presents People v. Marian court case involving New York (NY) Penal Law on cyberstalking. In this case Judge decided a case of first impression that a section of the NY Stalking Law requiring that the stalking conduct occurs at the complainant's place of business is not satisfied by the sending of repeated emails, wherein the defendant sent different forms of communication to her former girlfriend's work email address and was then arrested and charged with talking misdemeanors.
