- Abstract
The article discusses the effects of removing the juvenile sentencing authority from the U.S. legislature under the decision of U.S. Supreme Court in the case of Miller v. Alabama. It informs that the Court held that any sentencing scheme mandating life in prison without the possibility of parole (LWOP) for juveniles is unconstitutional under the Eighth Amendment. It analyze decisions in cases including Roper v. Simmons, Graham v. Florida, and Atkins v. Virginia related to juvenile sentencing.
