- Abstract
The article discusses the use of the CBP One mobile app for asylum seekers at the Southwestern border of the United States. The app has requirements and limitations, such as the need for a smartphone and internet access, which create barriers to accessing asylum. The article argues that the use of the app violates due process rights and suggests applying procedural due process to its usage. It also explores the concepts of due process for asylum seekers and the extraterritoriality doctrine. The app frequently glitches and appointments are not available at all ports of entry, further hindering access to the asylum process. The article suggests removing practical barriers, improving the app, and providing alternative options for those who cannot use it.
