- Abstract
The article discusses the Supreme Court of Pennsylvania's decision in Middletown Township v. Lands of Stone, regarding the ability of second-class townships to exercise eminent domain in Pennsylvania. Similar cases handled by the Supreme Court of Pennsylvania are analyzed. The court's majority and dissenting opinions in the case are presented. The court's interpretation of the Township Code and the Open Space Lands Act is examined.
